Counter Claim Confusion

Counter claims are a useful tactic for putting pressure on a Claimant if nothing else but remember under the ERA that you can only add a counter claim as a Respondent if the Claim is for a contractual breach.

A personal injury claim can be also be claim under a no win no fee policy. This policy can help claimants who are afraid that in pursuing a claim, it'll cost them much. No win no fee simply means, win or lose, you won't have to pay for the solicitor's fee.

In my opinion while the term 'no win no fee' is now commonly recognised, most people still do not know precisely what it means, and how it affects personal injury claims.
